En el presente artículo, el autor analiza la adecuada reinserción social del recluso como finalidad de la ejecución de la pena privativa de la libertad. Con ese propósito, el jurista identifica los diferentes modelos de readaptación social (“readaptación para la moralidad” y “readaptación para la legalidad”), con sus virtudes y críticas. Por último, Arocena examina los condicionamientos que impone un arquetipo de Estado social y democrático de Derecho, a la hora de adherir a uno u otro de esos modelos, (...) y finalmente expone sus razones a favor de un paradigma de readaptación social mínimo. The adoption of artificial intelligence (AI) in small and medium-sized enterprises (SMBs) has emerged as a key strategy for improving quality management. This article discusses the main benefits and challenges of implementing AI in this context. A systematic review of the academic literature and relevant business reports was carried out, in order to collect and analyze empirical evidence on the application of AI in the quality management of SMEs, obtaining as results that the main benefits of the implementation of AI (...) in the quality management of SMEs include: Improved data-driven decision-making, process automation and error reduction, early detection of quality issues, customization of products and services, and resource optimization and cost reduction. On the other hand, the main challenges were: Lack of knowledge and skills in AI, high implementation costs, concerns about data security and privacy, resistance to cultural change, and integration of AI with existing systems and processes, concluding that the implementation of AI in SMB quality management offers significant benefits, but it also entails challenges that must be addressed strategically. SMEs that manage to overcome these challenges will be able to take advantage of the competitive advantages offered by AI, improving their efficiency, quality and adaptability in an increasingly dynamic business environment. We present a fully relational definition of inertial systems based in the No Arbitrariness Principle, that eliminates the need for absolute inertial frames of reference or distinguished reference systems as the ``fixed stars'' in order to formulate Newtonian mechanics. The historical roots of this approach to mechanics are discussed as well. The work is based in part in the constructivist perspective of space advanced by Piaget. We argue that inertial systems admit approximations and that what is of practical use are (...) precisely such approximations. We finally discuss a slightly larger class of systems that we call ``relatively inertial'' which are the fundamental systems in a relational view of mechanics. (shrink)

While mechanics was developed under the idea of reciprocal action (interactions), electromagnetism, as we know it today, takes a form more akin to unilateral action. Interactions call for spatial relations, unilateral action calls for space, just one reference centre. In contrast, interactions are matters of relations that require at least two centres. The development of the relational electromagnetism encouraged by Gauss appears to stop around 1870 for reasons that are not completely clear but are certainly not solely scientific. By the (...) same time, Maxwell recognised the equivalence in formulae of his electromagnetism and the one advocated by Gauss and called for an explanation of why such theories so differently conceived have such a large part in common. In this work we reconstruct and update the relational electromagnetism up to the contributions of Lorentz guided by the non-arbitrariness principle (NAP) that requests arbitrary choices to be accompanied by groups of symmetries. We show that a-priori there must be two more symmetries in electromagnetism, one related to the breaking (in the description) of the relation source/detector and one relating all the perceptions of the same source by detectors moving with different (constant) relative velocities. We show that the idea of electromagnetic waves put forward in concept by Lorenz (1861-1863) before Maxwell (1865) and in formulae (1867) just after Maxwell, together with the ``least action principle'' proposed by Lorentz are enough to derive Maxwell's equations, the continuity equation and the Lorentz' force, and that there is a dual formulation in terms of fields of the receiver (as opposed to fields of the source). While Galilean transformations are associated with removing the arbitrariness implied in the election of a reference space, they will not explicitly appear in a formulation based upon a relational space although we occasionally mention their usefulness. In contrast, Lorentz' transformations will emerge in this formulation involving the relations between the perceived fields of different receivers. Moreover, the role of the full Poincaré-Lorentz group as a group of transformations of the perceived actions is elucidated. In summary, we answer Maxwell's philosophical question showing how the same theory in formulae can be abduced using different inferred entities. Each form of abduction implies as well an interpretation and a facilitation of the theoretical construction. This work relies heavily on logical concepts as abduction put forward by C. Peirce, needed for the construction of theories. (shrink)

Una relación que trasciende la institución y se incardina con la vida social, política e intelectual de la región donde se enclava.

We integrate dualistic conceptions of the real with Peirce's perspectives about reality and abduction, emphasizing the concept of reason underlying Peirce's thoughts. Peirce's abduction is related to the notions of retrogression and grounding in Hegel, later re-encountered in Hansonian-abduction. Abduction in turn is considered in relation to abstraction acquiring its fullest sense as a stage in the process of producing a theory. The process is iterative and self improving, it incorporates ``turbid thinking'' making it increasingly ``clear'' at successive iterations that (...) incorporate the lessons taught by failed predictions, i.e., refutations. The cycle of thoughts promoted by doubts comes to rest when belief is reached. We discuss how this coming to rest depends on a criterion for cessation of doubts. The observation is illustrated with two different criteria, one proposed by Mach that only demands analogy and the criteria of dualists such as Goethe and Whewell that inspire the present work. Hence, it is possible to produce, and socially accept, imperfect theories unless we demand the highest level of rationality, avoiding any leftover of the turbid thoughts that have been used in the early developments. This work rests upon the existence of some objective form of reason. Influenced by a constructivist, Piagetian, perspective of science, we propose and discuss a small number of conditions that we identify as characteristics of rational abduction: rules for the rational construction of theories. We show how a classical example of belief that satisfies today's most common definition of abduction does not match the standards of rational retroduction. We further show how the same rules indicate the partial detachment of Special Relativity from the observable world, a fact actually known to Einstein. We close arguing that there is an urgent need to develop a critical epistemology incorporating dualistic perspectives. (shrink)

La Universidad Nacional San Luis Gonzaga, Ica-Perú, debido al Covid 19 se adecuó a la virtualidad implementando el aula virtual Laureasea. Esta investigación se realizó durante el semestre académico 2021-1. Objetivo: analizar de qué manera la educación virtual mejora el desempeño docente. Participaron 430 docentes de las 24 facultades respondiendo una encuesta virtual. Resultados significativos: 80% dictó una clase virtual por primera vez, 60% tenía acceso a una aula virtual, 68% ha mejorado su desempeño y 75% prefiere las clases presenciales. (...) This article gives a conceptual review of the e-value, ev(H|X) – the epistemic value of hypothesis H given observations X. This statistical significance measure was developed in order to allow logically coherent and consistent tests of hypotheses, including sharp or precise hypotheses, via the Full Bayesian Significance Test (FBST). Arguments of analysis allow a full characterization of this statistical test by its logical or compositional properties, showing a mutual complementarity between results of mathematical statistics and the logical desiderata lying at (...) the foundations of this theory. La propuesta gnoseológica de Ricardo Sánchez Ortiz de Urbina de retirar al Ego trascendental sus funciones gnoseológicas no es inocua para el materialismo. Tiene consecuencias ontológicas y socio-antropológicas. En esta primera parte se ilustran las primeras, discutiendo las diferencias entre el materialismo filosófico del Gustavo Bueno, tal como aparece formulado en sus textos canónicos, y el materialismo fenomenológico, que propone Urbina a propósito de lo «trascedental». Para ello uso como filtro crítico un tercer materialismo, el de Gilles Deleuze, sobre (...) cuya filosofía nómada sólo se efectúan unos apuntes esquemáticos, pero suficientes para «espantar» a los fantasmas de la razón. La referencia a Deleuze en el debate sobre las consecuencias ontológicas que trae el planteamiento de Urbina es obligada, no sólo por las prevenciones que manifiesta Urbina en su texto «a causa de su radicalidad», sino sobre todo, porque sus propuestas estaban ya presentes (como referencia implícita) en las propias formulaciones iniciales del materialismo filosófico. El autor pasa revista a la concepción de la historia como disciplina que exhibe el filósofo Fernando Miguel Pérez Herranz. El motivo de este concienzudo análisis es la publicación en marcha del magno proyecto Más allá de imperios y naciones (4 vols.) iniciado en 2023 y que ya cuenta con dos tomos en el mercado: Rutas, fronteras y complejidad y Singularidad imperial: del Mediterráneo al Atlántico. Esta concepción del estatuto gnoseológico de la historia tiene en Lindos y tornadizos (2016) y (...) en Ambiguus proetus (2019) dos momentos esenciales que dibujan el paso Herranz a su perspectiva (la morfología filosófica) en el debate entre Gustavo Bueno y Ricardo Sánchez Ortiz de Urbina a cuenta del sujeto trascendental. En tal contexto cobran relevancia las hipercategorías formuladas por Pérez Herranz y cuyo estatuto resulta problemático. (shrink)

We provide a 'verisimilitudinarian' analysis of the well-known Linda paradox or conjunction fallacy, i.e., the fact that most people judge the probability of the conjunctive statement "Linda is a bank teller and is active in the feminist movement" (B & F) as more probable than the isolated statement "Linda is a bank teller" (B), contrary to an uncontroversial principle of probability theory. The basic idea is that experimental participants may judge B & F a better hypothesis about Linda as compared (...) to B because they evaluate B & F as more verisimilar than B. In fact, the hypothesis "feminist bank teller", while less likely to be true than "bank teller", may well be a better approximation to the truth about Linda. (shrink)

Following Galileo's trial of 1633, the Jesuit theologian Melchior Inchofer, author of the most negative reports used by the Roman Inquisition against Galileo, repudiated the Copernicans for the ‘heresy’ of the soul of the world (anima mundi), in an unpublished manuscript. I show that Inchofer's arguments applied far more to the beliefs of Giordano Bruno than to those of Galileo. Since antiquity, various Christian authorities had repudiated several beliefs about the anima mundi as ‘heretical’, hence I review their critiques against (...) Pythagoras, Origen, and Peter Abelard, for allegedly asserting animistic beliefs about the Earth, or a universal spirit, or that souls move the heavenly bodies. Still, in the Renaissance such beliefs were defended by several advocates of Copernicus, including Bruno, William Gilbert, Johannes Kepler, and Philips Lansbergen, who all claimed that Earth moves because it has a soul. By comparing Inchofer's works and some of the Roman Inquisition's earlier censures against Bruno, I argue that the repudiation by many prominent Catholic theologians of pagan notions of the anima mundi as heretical contributed partly to the later theological opposition to the Copernicans. En prenant comme point de départ la doctrine cartésienne, Pascal et Malebranche élaborent une réflexion sur l’imagination en tant que force paradoxale qui domine l’existence humaine. Les analyses de la Recherche de la vérité sont toutefois incompréhensibles sans les prémisses des Pensées où l’imagination est reconnue comme irréductible à l’opposition entre « grandeur » et « misère » de l’homme. Ce sera donc en rejetant cette opposition que (...) Malebranche pourra s’approprier l’héritage pascalien et penser ainsi l’imagination comme « reine du monde ».Pascal is one of the main sources of the pages by Malebranche on imagination. Starting from the Cartesian characterisation, both propose a reflection on imagination as an ambiguous strength that dominates human existence. The analysis of the Recherche de la vérité result incomprehensible without the precedent of the Pensées. There imagination is recognized as an element that cannot be reduced to the opposition between the human « grandeur » and « misère ». By refusing this opposition Malebranche is fully entitled to Pascal’s legacy and he will so underline the role of imagination as « reine du monde ». (shrink)

Antonio Rosmini-Serbati was one of the first natural law scholars to bring natural law thinking into a conversation with the market economic order that was beginning to emerge in Europe in the 19th century. His reflections on matters such as the origin, nature, and limits of private property, the role of the state, and the nature of human reason show him to be a unique, innovative thinker who nonetheless was determined to work within the parameters of Catholic doctrine. Many of (...) these ideas are concretized in his seminal work The Constitution Under Social Justice, a text that has profound instights to offer those today seeking to integrate theology, philosophy, and economics into their conceptions of a social order that aspires to be both free and just.
